John D. Herrick, Esquire

Of the hundreds of defendants handled by Mr. Herrick, only two have gone to jail or prison.

Most recently, Mr. Herrick was featured on Court TV defending a mother who was charged with causing the death of her child by omission. The Court TV anchors used terms such as “outstanding”, "excellent," and “zealous advocate for his client” concerning the quality of his legal representation. The popular opinion on the case was that the mom should get the maximum sentence of 20 years in prison. Some viewers even e-mailed Court TV saying that a person who kills a child should get death. Ultimately, Mr. Herrick argued to the jury that his client should receive probation and the jury agreed. The defendant was given only probation with no fines or community service.

Mr. Herrick has helped hundreds of people avoid the life-long consequences of a criminal conviction, from municipal cases up to and including death penalty cases. Recently, Mr. Herrick was responsible for avoiding the death penalty in a case where prosecutors alleged that the defendant burned down the home in which she resided, killing her husband. Despite a 15-page confession and mountains of forensic evidence, Mr. Herrick was still able to avoid the death penalty for his client, saving her life.

Sexual Assault

Mr. Herrick pleaded consent as a defense and put on enough evidence discrediting the State's witnesses to deadlock the jury. A mistrial was declared and the State has not re-filed any charges.

 

Possession of Controlled Substance/Intent to Distribute

Several cases dismissed based on pre-trial motions to suppress evidence based on law enforcement's violation of the 4th Amendment (illegal search and seizure).
